US govt stifles scrutiny on Nigerians over Visa overstay

The United States Mission in Nigeria has reaffirmed its warning to Nigerian travellers over visa overstays, adding that possessing a valid US visa does not automatically determine how long a visitor is permitted to remain in the country.

This clarification is  coming just as US immigration authorities intensify scrutiny of visa compliance, particularly among nationals of countries with notable overstay rates. The advisory was issued on Monday through the Mission’s official X account under its #VisaWiseTravelSmart campaign, aimed at educating visa holders on US immigration rules.

According to the Mission, the duration of every visitor’s stay in the United States is determined solely by officers of the US Customs and Border Protection (CBP) at the point of entry, regardless of the validity period printed on the visa.

“Reminder! The length of time an international visitor is allowed to stay in United States is determined by the Customs and Border Protection (CBP) officer upon your arrival, NOT your visa expiration date,” the Mission stated.

It explained that a US visa merely authorises an individual to travel to a US port of entry and request admission, while the final decision on the length of stay rests with immigration officials.

The renewed warning follows increasing attention by US authorities to visa overstays involving Nigerian nationals. Recent immigration data and policy reviews indicate that Washington is paying closer attention to countries with relatively high rates of non-compliance with visa conditions, with Nigeria among those under review.

The Mission reiterated that remaining in the United States beyond the authorised ‘Admit Until Date’, even when the visa itself remains valid, constitutes an immigration violation that could attract serious consequences.

According to the Mission, such violations may result in the cancellation of existing visas, denial of future visa applications and other immigration sanctions that could affect an individual’s ability to travel to the United States.

Official figures released by US authorities show that Nigeria recorded a 5.56 per cent overstay rate among holders of B-1/B-2 visitor visas, while the overstay rate for student and exchange visas under the F, M and J categories stood at 11.90 per cent.

The US has repeatedly expressed concern over rising visa overstay rates globally, noting that compliance with immigration rules remains a key consideration in assessing future visa policies and processing procedures.

As part of efforts to improve compliance, the US Mission said it has expanded its #VisaWiseTravelSmart awareness campaign to educate prospective travellers on visa regulations, interview preparation and post-arrival obligations.

The Mission further warned that visa overstays by individuals could have wider implications for Nigerian applicants, including stricter visa screening procedures, longer processing timelines and increased documentation requirements for future travellers.

With growing number of Nigerians travelling to the United States annually for education, tourism, business and family visits, the Mission advised all travellers to verify their electronic I-94 arrival records immediately after entry and ensure they depart before the expiry of their authorised stay to maintain a clean immigration record and safeguard future travel opportunities.
